By accessing or using Fleye.io (the Website and related services, together the Service), you agree to these Terms & Conditions. If you do not agree, do not use the Service.

These Terms contain two parts:

  1. Terms of Use — rules for accessing and using the platform

  2. Terms of Sale — pricing, payments, cancellations, refunds

Definitions

  • Client: any person or entity posting a project or purchasing deliverables.

  • Pilot: an independent professional drone operator using the platform to accept missions.

  • Mission: a project posted by a Client, including brief, location, timing, deliverables and budget.

  • Deliverables: photos, videos, datasets and 3D assets produced for a Mission.

  • Escrow: funds held by the payment processor until Client approval.

1) Terms of Use

1.1 Role of Fleye.io

Fleye.io provides a marketplace and tools to connect Clients and independent Pilots. Fleye.io is not a carrier or air operator and does not perform flights. Contracts for services are formed directly between Client and Pilot.

1.2 Accounts and eligibility

Users must be 18 or older and provide accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

1.3 Pilot compliance and safety

Pilots operate independently and are solely responsible for:

  • Holding all required licenses, authorizations and insurance in their jurisdiction.

  • Complying with applicable UAS rules and local restrictions, obtaining flight permits, respecting privacy and property rights and ensuring third-party safety.

  • Verifying airspace, NOTAMs and any municipal or private authorizations needed for the Mission.

Clients confirm that their briefs are lawful and do not infringe third-party rights.

1.4 Mission workflow

  1. Client posts a brief with location, date, deliverables, format specs and budget.

  2. Eligible Pilots are notified and may apply. Client selects a Pilot based on profile, ratings and portfolio.

  3. Client pays an advance or full amount into escrow via the payment processor.

  4. Pilot performs the capture as per the brief and uploads Deliverables through the platform.

  5. Client approves or requests adjustments within the review window stated on the Mission page.

  6. Upon approval, escrow funds are released to the Pilot minus service fees.

1.5 Intellectual property and usage rights

Unless otherwise agreed in the brief or purchase order:

  • Ownership of Deliverables transfers to the Client upon full payment, limited to the uses, territory and duration stated in the brief.

  • The Pilot warrants they hold all necessary rights and filming permissions.

  • The Pilot grants Fleye.io a limited non-exclusive license to host, process and display Deliverables for Mission execution, support and platform operation.

  • Unless a confidentiality clause applies, the Pilot may reference the Mission in their portfolio.

1.6 Reviews, content and non-circumvention

Reviews must be honest and lawful. It is prohibited to exchange direct contact details to bypass the platform for 12 months after first connection between a Client and a Pilot. If circumvention occurs, Fleye.io may claim a liquidated amount equal to the service fees that would have applied.

1.7 Prohibited conduct

You must not misuse the Service, attempt to gain unauthorized access, upload malware, infringe third-party rights or use the Service for unlawful purposes.

1.8 Suspension and termination

Fleye.io may suspend or terminate accounts for fraud, non-payment, repeated cancellations, safety concerns, infringement of these Terms or third-party rights.

1.9 Warranties and liability

The Service is provided “as is”. Fleye.io does not guarantee uninterrupted availability or error-free operation. Fleye.io is not responsible for flights, permits, weather disruptions, administrative restrictions, artistic results or third-party failures. To the maximum extent permitted by law, Fleye.io’s total liability is limited to the service fees collected by Fleye.io for the Mission at issue.

1.10 Personal data

Processing of personal data is described in our Privacy Policy. Cookies and trackers are managed through our Cookies Policy and a CMP (Consent Management Platform).

1.11 Third-party links

The Service may contain links to third-party websites or services. Fleye.io is not responsible for their content, availability or practices.

2) Terms of Sale

2.1 Prices, taxes and currency

Unless stated otherwise, prices are shown exclusive of taxes. Applicable taxes are added at checkout. The currency used and any conversion will be displayed by the payment processor.

2.2 Payments and escrow

Payments are processed by [Payment processor, e.g., Stripe]. For Missions using escrow, funds are held until Client approval or until the applicable release conditions are met. Fleye.io does not store card numbers.

2.3 Service fees and charges

Fleye.io charges service fees on amounts billed to the Client. Fees may apply to Client and/or Pilot:

  • Client service fee: [X%]

  • Pilot service fee: [Y%]
    Additional charges may apply for distance beyond the Pilot’s declared radius, urgent scheduling or technical options such as high-density photogrammetry.

2.4 Invoices

Invoices are issued electronically. Pilots remain responsible for their own invoicing to Clients where applicable and for their tax and social obligations.

2.5 Cancellations and refunds

  • Client cancellations

    • More than 72 hours before the scheduled start: refund of non-committed amounts, excluding Fleye.io service fees and non-recoverable third-party expenses.

    • 72 to 24 hours: partial refund of [X%].

    • Less than 24 hours: non-refundable except force majeure.

  • Pilot cancellations
    Fleye.io may propose a replacement Pilot when feasible or arrange a refund of unused amounts to the Client.

  • Weather, airspace restrictions, denied permits
    Priority is rescheduling under comparable conditions. If rescheduling is not possible, a refund may be issued excluding non-recoverable costs.

2.6 Delivery, review and acceptance

Deliverables are provided through the platform. The Client must review within the stated window. If the Deliverables do not match the brief, the Client may request reasonable adjustments. Approval triggers release of escrow to the Pilot minus fees.

2.7 Chargebacks and disputes

Unjustified chargebacks may lead to account suspension. For disputes, contact contact@fleye.io.
If the Client is a consumer located in France or the EU, see section 2.10 for mediation and ODR.

2.8 Right of withdrawal for EU consumers

If the Client qualifies as a consumer under EU or French law, a 14-day withdrawal right may apply. This right does not apply to services fully performed before the end of the withdrawal period with the consumer’s express consent or to dated services that cannot be resold. See French Consumer Code article L221-28.

2.9 Currency conversion and bank fees

Your bank or card issuer may apply conversion rates and fees outside Fleye.io’s control.

2.10 Governing law, venue and consumer mediation

Changes to these Terms

We may update these Terms at any time. The version posted on the Website at the time of use applies. Material changes will be indicated by updating the “Last updated” date.
